Last week, the Superior Court of Alameda County issued a ruling supporting the city’s defense in the lawsuit filed against the City by ex-interim fire chief David Kapler. Kapler’s attorney, Denise Eaton-May has 10 days to amend their original lawsuit, to see if she can convince the judge that Kapler has facts to present that are even up for discussion in a court of law. Failure to do so will result in the case being tossed out.
The City has filed a motion (anti-SLAPP) going after Kapler for legal costs based on his filing a lawsuit that had no chance of winning.
